Tailgating is an integral part of the game day experience. You get together with some buds, drink some beer, throw some meat on the barbeque and get ready to have a great time cheering on your favorite team. Aside from a loss, there isn’t much that can bring you down; after all, you’re there to keep the party going. But what if we told you that there are liability issues at stake that could potentially derail your tailgating for good?
Legal Liability at the Venue
Sure, you’re parked in a lot. Maybe it’s publically owned, maybe it’s private, one way or another, you don’t own it. Think that leaves you out of the liability discussion should someone from your party suffer an injury? Wrong. Your camper, trailer, folding chairs and barbeque serve to make you an active participant in a case of personal injury. It can, and will, be successfully argued that without your participation said injury were to have never occurred.
A tailgate party can go on for hours, and that means there is bound to be some food left out longer than it should. Let’s say one of your guests picks up a plate of potato salad and chows down only to find out later that the mayonnaise turned and they’ve contracted food poisoning. You are now liable for their medical bills, loss of income, and in the most dire of instances, death.
To minimize the risks associated with food poisoning, be sure to keep your hot foods hot, and your cold foods cold. Think ice chests and temperature controlled warming trays.
Social Host Over-serve
As a host, you are legally liable for serving alcoholic beverages. Just as if you were tending bar at the local dive, it is your responsibility to ensure that you are not over-serving your guests, or providing alcohol to minors. Try to limit the number of drinks consumed by your guests, and keep handy the number of a local cab company. Better safe than sued.
One-Day Event Liability Insurance
Your Homeowners Insurance will not cover you for an off-premise activity like tailgating. Consider purchasing a one-day event liability insurance plan to protect your next party.
